Use of Site: The information contained on this site and in any applications or tools available on the site is not intended to be a complete listing of all Products/Services, but will be selected to include most of the major Products/Services that the Customer typically orders. Agilent Technologies will attempt to accommodate whatever requests the Customer may have regarding the selection of Product information; but the final decision on the information included rests solely with Agilent Technologies.
Agilent Technologies will use its reasonable efforts to provide current information. However, as a result of limitations inherent in the production of this type of information, the Customer understands that it will not be possible for Agilent Technologies to ensure that all information for every Product /Service is complete or accurate and therefore agrees to accept the information on an "estimate" basis only. Both parties agree that the Customer is solely responsible for the application software (WWW browser) and Internet connectivity used to access this application.  

Use of Software. If Customer downloads software from this Site ("Software"), use of the Software is subject to the license terms in the Software License Agreement that accompanies or is provided with the Software. Customer may not download or install the Software until reading and accepting the terms of the Software License Agreement. Both parties agree that the Customer is solely responsible for the application software (WWW browser) and Internet connectivity used to access this application.

General: Agilent Technologies may revise these Terms of Use and Software License Agreement at any time by updating this posting. You should visit this page from time to time to review the then-current Terms of Use because they are binding on you. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages at this Site. Your existing Terms and Conditions with Agilent Technologies including those related to service, supply of products and/or other business transactions will continue to apply together with these Terms of Use.




Specific Terms:


1. Registration: The Customer is responsible for assuring authorization from Customer's company prior to registration. Customer is also responsible for keeping a personal login and password/PIN  confidential after registration. Each customer is required to keep an on-line profile current and accurate.

2. Company Invoicing Number: THE STATUS INFORMATION INDICATED IS CALCULATED BASED ON CUSTOMER’S INVOICING NUMBER. The customer invoice number depends in part on the customer’s invoicing address. In the case that multiple customer’s sites are invoiced to a unique invoicing address without ability to create unique customer numbers, status reports will provide visibility for all company’s instruments associated with the company’s invoicing address (and not by customer user-site). It is the Customer’s responsibility to inform Agilent Technologies of problems concerning identification of customer user-sites within the Company organization.

3. Accessibility: Agilent Technologies will use its reasonable efforts to provide access to this site and its tools and applications. However, the Customer understands that the information may not be available continually or that it may be changed without notice.

4. Frequency of Updates: Agilent Technologies will use its reasonable efforts to update the information on a nightly basis. Agilent Technologies  will also use its reasonable efforts to update any significant changes or corrections. The Customer understands that, because of the volume of data being provided, Agilent Technologies cannot guarantee that all changes or corrections can be implemented or notification made.

5. Limitations on Use of Data: ALL INFORMATION PROVIDED ON THIS SITE IS AGILENT TECHNOLOGIES CONFIDENTIAL AND IS PASSWORD/PIN PROTECTED. Agilent Technologies is providing this information solely for the Customer's use in its own equipment management processes, and Customer agrees not to disseminate this information for any other purpose or through any other method including electronic or mechanical. The information  cannot be disclosed without Agilent Technologies' prior written consent. Agilent Technologies will provide this data as described above but reserves the right to discontinue this service at any time.

6. Cost to the Customer: The following advanced features are being provided by Agilent Technologies to the Customer on a no-cost basis.
 - Repair and Calibration status
 - Calibration Due Notification
 - Instrument Service Logging

7. Termination: If the Customer is no longer in good standing or if it breaches these Terms of Use, then Agilent Technologies may terminate Customer's access to this information immediately.

8. User Submissions. Any material, information or other communication Customer transmits or posts to this Site will be considered non-confidential and non-proprietary ("Communications"). Agilent Technologies will have no obligations with respect to the Communications. Agilent Technologies and its designees will be free to copy, disclose, distribute, modify, incorporate and otherwise use the Communications and all data, images, sounds, text, and other things embodied therein for any and all commercial or non-commercial purposes. Customer is prohibited from posting or transmitting to or from this Site any unlawful, threatening, defamatory, obscene, pornographic, or other material that would violate any law.

9. Links to other Web Sites. Links to third party Web sites on this Site are provided solely as a convenience to Customer. If Customer uses these links, Customer will leave this Site. Agilent Technologies has not reviewed all of these third party sites and does not control and is not responsible for any of these sites or their content. Agilent Technologies does not endorse or make any representations about them, or any information, software or other products or materials found there, or any results that may be obtained from using them. Customer's decision to access any of the third party sites linked to this Site is at Customer's own risk.

10. U.S. Government Restricted Rights. Government users will receive no greater than Restricted Rights as defined in FAR 52.22714, FAR 52.22719(c)(12) (June 1987) or DFAR 252.2277013(c)(1)(ii) (Oct 1988), DFAR 252.2217015(c)(May 1991), DFAR 252.2277014, or DFAR 252.2277018 or successor legislation as applicable in any Software at this Site. Government users will secure no greater than limited rights as defined in FAR 52.22714, DFAR 252.2277015, DFAR 252.2277018, or DFAR 252.2277013 or successor legislation as applicable in any technical data at this Site.

11. Electronic Messages. Messages (including but not limited to orders and acknowledgements) submitted electronically will have the same legal effect, validity and enforceability as if they were submitted in writing. In case local law requires information to be in writing, such requirement shall be deemed met by electronic messages generated, sent, received, stored or otherwise processed in connection with this Site.

12. Applicable laws. To the extent allowed by local law, these Terms will be governed by and construed in accordance with the laws of the country where Customer’s Agilent Technologies Test and Measurement Instrument entity is located, without giving effect to any principles of conflicts of laws, and any dispute relating to these Terms will be referred to the courts of such country. Agilent Technologies makes no representation that materials at this Site are appropriate or available for use in any country outside the above mentioned country, and access to these materials from territories where their contents are illegal is prohibited. If Customer chooses to access this Site from outside such country, Customer does so on Customer's own initiative and is responsible for compliance with applicable local laws.
